1 <br /> December 3, 1993 <br /> FIRST VERY VERY ROUGH DRAFT <br /> INTERGOVERNMENTAL AGREEMENT <br /> THIS AGREEMENT entered into by and between the Eugene Water and Electric <br /> Board, a municipal corporation, hereinafter referred to as EWEB, and the City <br /> of Eugene, a municipal corporation, hereinafter referred to as CITY. <br /> RECI ALS: <br /> X 7 \ , The CITY and EWEB recognize a need to meet requirements to safeguard <br /> public welfare and to increase efficiencies in public facility <br /> ��(\ maintenance. <br /> * EWEB recognizes CITY is responsible to maintain the trees within the <br /> A street right -of -ways. <br /> to erform line c le ran <br /> CITY recogniz EWEB has a gal obligation p a <br /> \,)\( ` act ivities to es the tolerances le re b the Public Utilit C ommission. <br /> EWEB and CITY recognize that healthy and aesthetically pleasing trees <br /> v have a beneficial impact on the livability of our area. `' <br /> Q J \ \ f it <br /> * EWEB and CITY recognize it is in the best interest of each agency to <br /> coordinate the work each performs on trees, to coordinate public V� <br /> information efforts, and cooperate in ways that increase maintenance <br /> efficiencies. <br /> CONTACT AND COORDINATION <br /> Where the on -going maintenance activities of EWEB in providing the mandated <br /> clearances to electrical lines impact trees under the jurisdiction of CITY, <br /> the parties hereby agree as follows: <br /> 1. Prior to performing major (what's major ?) line clearance activities on <br /> trees within the street right -of -way EWEB shall notify CITY of its <br /> intent to perform this work. <br /> 2. EWEB and CITY staff shall meet to evaluate the impact this work will <br /> have on the specific trees and reach a consensus of the extent of work <br /> to be performed. <br /> 3. A public notification plan will be agreed on depending on the magnitude <br /> of the work being performed way include but is not limited to: <br /> a. notice to abutting property owners. <br /> b. notice to interested Board /Council members <br /> c. notice to Neighborhood Organization <br /> d. news release <br /> 1 <br />
