If, after one year from line clearance pruning an abutting property owner feels <br /> the aesthetic appearance of a tree is unacceptable a request may be made for its <br /> removal. The CITY shall evaluate the tree for removal as described in section: <br /> "D. TREE REMOVAL ". Replacement trees shall be provided by the City with costs <br /> to be reimbursed by EWEB as described in section: "E. TREE PLANTING" <br /> 5. When during the course of performing maintenance pruning, EWEB discovers trees <br /> with excessive rot or other severe problems which suggest the tree poses a <br /> significant threat to life or property damage, such tree will be immediately <br /> reported to the CITY for evaluation and possible removal as described in section <br /> "D" TREE REMOVAL. <br /> D. TREE REMOVAL <br /> On the joint determination of EWEB and CITY staff that a city tree in conflict with <br /> utility lines needs to be removed the following process will be used. <br /> 1. A tree may be evaluated for removal if it meets one or more of the following <br /> criteria: <br /> a) If the tree is structurally unsound and poses a hazard. <br /> b) If the health of the tree is in significant decline. <br /> c) If past maintenance has damaged the tree beyond its ability to recover and <br /> assume a natural form. <br /> d) If the tree is on the list of trees prohibited in the Eugene Code for use <br /> in street right -of -ways. <br /> e) If the tree is a very fast growing species with a history of annual <br /> trimming being required to protect public safety. <br /> 2. If the tree is less than twelve (12) inches in diameter at breast height (dbh), <br /> EWEB will contact CITY and request a site meeting to discuss the trees removal. <br /> If staff from both agencies agree, EWEB then may remove the tree without further <br /> processing. If City staff believes the removal is desirable but would be <br /> controversial, then the process outlined in section "B" herein -below shall be <br /> used. <br /> 3. If the tree is twelve (12) inches dbh or greater the standard CITY process of <br /> public posting shall be followed. <br /> a) Photographs and a written description of the reasons for removal will be <br /> collected by CITY. In the event of an emergency removal, this <br /> documentation will be collected by EWEB and presented to CITY. <br />
