Apri1.1, 1994 <br /> DRAFT <br /> INTERGOVERNMENTAL AGREEMENT <br /> THIS AGREEMENT entered into by and between the Eugene Water and Electric <br /> Board, a municipal corporation, hereinafter referred to as EWEB, and the City <br /> of Eugene, a municipal corporation, hereinafter referred to as CITY. <br /> RECITALS: <br /> * CITY and EWEB recognize a need to meet requirements that safeguard <br /> public welfare and increase efficiencies in public facility maintenance. <br /> * EWEB recognizes CITY is responsible to maintain the trees within the <br /> street right -of -ways. <br /> * CITY recognizes EWEB has a legal obligation to perform line clearance <br /> activities to the tolerances required by the Oregon Public Utility <br /> Commission. <br /> * EWEB and CITY recognize that healthy and aesthetically pleasing trees <br /> have a beneficial impact on the livability of our area. <br /> * CITY and EWEB recognize it is in the best interest of each agency to <br /> coordinate the work each performs on trees, to conduct joint training <br /> opportunities for crews, to coordinate public information efforts, and <br /> cooperate in ways that increase maintenance efficiencies. <br /> * EWEB and CITY recognize it is in the best interest of Eugene's Urban <br /> Forest and each agency to insure trees are not planted beneath overhead <br /> power lines which, when reaching maturity, will conflict with those <br /> power lines. <br /> * CITY and EWEB are committed to the earliest replacement that is <br /> practical for trees that have been removed due to conflict with overhead <br /> lines. <br /> A. SCOPE OF AGREEMENT <br /> The provisions of this agreement only pertain to those trees located on street <br /> right -of -way or on property owned by the City of Eugene. <br /> B. CONTACT AND COORDINATION <br /> Where the on -going maintenance activities of EWEB in providing the mandated <br /> clearances to electrical lines impact trees under the jurisdiction of CITY, <br /> the parties hereby agree as follows: <br /> 1 <br />
