request may be made for its removal. The CITY shall evaluate the tree <br /> for removal as described in section "D. TREE REMOVAL." Replacement <br /> trees shall be provided by the City with costs to be reimbursed by EWEB <br /> as described in section "E. TREE PLANTING." <br /> 5. When, during the course of performing maintenance pruning, EWEB <br /> discovers trees with excessive decay or other severe problems which <br /> suggest the tree poses a significant threat to life or property damage, <br /> such tree will be immediately reported to the CITY for evaluation and <br /> possible removal as described in section "D. TREE REMOVAL." <br /> D. TREE REMOVAL <br /> Upon the joint determination of EWEB and CITY staff that a city tree in <br /> conflict with utility lines needs to be removed, the following process will be <br /> used. <br /> 1. A tree may be a candidate for removal if it meets one or more of the <br /> following criteria: <br /> a) If the tree is structurally unsound and poses a hazard. <br /> b) If the health of the tree is in significant decline. <br /> c) If past maintenance has damaged the tree beyond its ability to <br /> recover and assume a natural form. <br /> d) If the tree is on the list of trees prohibited in the Eugene Code <br /> for use in street right -of -ways. <br /> e) If the tree is a fast - growing species with a history of annual <br /> trimming being required to protect public safety. <br /> 2. If the tree is less than twelve (12) inches in diameter at breast height <br /> (dbh), EWEB will contact CITY and request a site meeting to discuss the <br /> tree's removal. If staff from both agencies agree. EWEB then may remove <br /> the tree without further processing. If city staff believes the removal <br /> is desirable but would be controversial, then the process outlined in <br /> section "B. CONTACT AND COORDINATION" shall be used. <br /> 3. If the tree is twelve (12) inches dbh or greater, the standard CITY <br /> process of public posting shall be followed. <br /> a) Photographs and a written description of the reasons for removal <br /> will be collected by CITY. In the event of an emergency removal, <br /> this documentation will be collected by EWEB and presented to <br /> CITY. <br /> b) If the tree poses an immediate and severe hazard to life or <br /> property, the tree may be removed without further notice. <br /> 3 <br />
