V <br />I just want to flag that this agreement is over only when: <br />1. 50% of the property within the District is annexed. <br />2. The passage of twenty years <br />3. The passage of ten years and the District wanting out at that time. <br />Again, I do not see a safety net for the City if providing funding for this <br />the agreement becomes onerous to us in the future. <br />In general, the eight page "Intergovernmental Agreement" documents and makes <br />formal "the understanding" on several items that each agency agrees to for the <br />three year AFTER the district is absorbed into the City. This includes <br />absorbing the personnel, facilities and agreeing to be governed by a "Trans- <br />ition Board ". <br />CONCERNS 2nd - agreement: <br />Page 1, Paragraph B.: <br />"The District seeks assurances that its investments in park facilities will be <br />maintained and that staffing and services will not decline as a result of such <br />annexation ". <br />My concern here that we may well be unable to keep this promise. There is a <br />disclaimer in the next paragraph on our ability to commit future resources but <br />it seems weak. <br />Page 2, Paragraph D.: <br />1. "Maintain the District's level of recreational programming;" <br />This doesn't say anything about how the level of services in the district <br />compare to those provided to the rest of the City. It seems that a tie <br />between the two would be wise. <br />2. "Absorb all District Employees into the City's Parks, Recreation and <br />Cultural Services Department with the'same status as other City employ- <br />ees. District employees will retain their original; date of employment <br />with the District (seniority date) upon transferring to City employ- <br />ment." <br />Discussions with Louren Chouniard lead me to believe this is far to specific a <br />promise. We need to abide with ORS 236.605 to 236.650 and say so herein. <br />Being more specific may give us specific people and union problems. <br />Page 2, Number 1. City Obligations: <br />"...the City agrees to maintain the existing operational and maintenance <br />budget amounts for the Emerald Park Facilities." <br />This would seem to take away the ability to make use of savings through <br />
