Parks & Open Spaces Notice of Restriction of Use <br />Appeal Procedures <br />(For staff informational purposes only.) <br />1. Police officer issues J. Doe a Notice of Restriction of Use on the revised form. A copy of this <br />Notice is not sent to Municipal Court. <br />2. J. Doe contests the Notice by requesting an informal appeal with the Parks & Open Spaces <br />Division Director. The request for an informal hearing must be made within 48 hours of receiving <br />the Notice. <br />3. The Division Director holds the informal hearing within 72 hours of receiving the request. <br />4. After the informal hearing, the Division Director issues a decision on the "Decision form." The <br />Decision form is attached to the front of the initial Notice of Restriction of Use, along with copies <br />of any police report or citation that was issued to J. Doe. This packet of documents is forwarded to <br />Municipal Court. <br />5. The process for appealing the Division Director's decision is identical to the process for appealing <br />a mall exclusion notice, i. e., J. Doe's municipal court hearing date is stated in the Division Director's <br />decision (the next Tuesday or Friday, whichever comes first, except that decisions issued after noon <br />on Monday will be set for the following Friday, and decisions issued after noon on Thursday will <br />be set for the following Tuesday). J. Doe must call before 1 p.m on the day before the hearing to <br />state if he is going to appear at the hearing. If so, the municipal court clerk will add J. Doe's name <br />to the officer trial line for the next day. <br />6. The police officer must call the officer trial line, after 5:00 p.m., the day before the hearing to see <br />if J. Doe called and requested a hearing. <br />7. If J. Doe appears without calling, the hearing will be rescheduled for one week later. A notice <br />will be sent to the officer informing him/her of the hearing date. <br />8. After the hearing, Municipal Court will fax the Judge's decision to Parks & Open Spaces and to <br />EPD. <br />9.
