ADMINISTRATIVE ORDER NO. 21 -03 -_ <br />of the <br />City Manager <br />City of Eugene, Oregon <br />The City Manager of the City of Eugene finds that: <br />A. Under the provisions of Chapter IV, Section 16 of the Eugene Charter of 1976, the <br />City Manager was designated as the administrative head of the City, was specifically authorized to <br />appoint and remove all employees (except as otherwise provided in the Charter), organize, disband, <br />or reorganize City departments, and to enforce all ordinances of the City. Pursuant to that authority, <br />in 1992 the City Manager reorganized the Public Works Department and Parks, Recreation and <br />Cultural Services Department ( PARCS), with many of the functions, duties and responsibilities <br />previously performed by the PARCS Department becoming the function, duty or responsibility of <br />the Public Works Department. The same authorizations are contained in Chapter IV, Section 16 of <br />the Eugene Charter of 2002 (subject to the limitations contained therein). <br />B. At that time Sections 2.812 to 2.817 of the Eugene Code, 1971 (EC), authorized or <br />required specific duties or acts to be performed by the person designated by the City Manager as the <br />Executive Director ofthe Parks, Recreation and Cultural Services Department, and EC Section 4.330 <br />authorized the City Manager or designee to designate areas within City parks where dogs may be <br />allowed to run off leash. <br />C. On November 30, 1992 the City Manager issued Administrative Order No. 44 -92 -12 <br />designating the Executive Director of the Public Works Department as the person to carry out the <br />duties and responsibilities referenced in finding B above, and rescinding any prior orders in conflict <br />therewith. <br />D. Although EC Sections 2.812 to 2.817 were repealed by Ordinance No. 20015 on May <br />22, 1995, subsequent administrative orders of the City Manager have confirmed the continuing <br />authority delegated by Administrative Order No. 44- 92 -12. <br />E. Due to the passage of time and the limitations on access to EC Sections 2.812 to <br />2.817, the authority delegated in Administrative Order No. 44 -92 -12 should be reaffirmed and the <br />duties and responsibilities re- delegated as set forth herein, with that order rescinded as of the <br />effective date of this Administrative Order. <br />Now, therefore, based upon the above findings, which are hereby adopted, <br />The City Manager of the City of Eugene orders and directs that: <br />1. Administrative Order No. 44- 92 -12, is hereby rescinded, as of the effective date of <br />this Administrative Order. <br />2.
