(d) Any notice that restricts a person's future use pursuant to subsections <br />(3)(a) and (3)(b) of this section shall contain a statement advising of the right to <br />request a hearing in the manner set forth in section 1.074 or section 1.075 of these <br />rules. <br />1.007 POSSESSION OR CONSUMPTION OF HARD LIQUOR, MALT <br />BEVERAGES AND ALCOHOLIC LIQUOR. <br />(1) Definitions For purposes of this Rule, the following definitions as contained <br />in Section 4.105 of the Eugene Code, 1971 for malt beverage, alcoholic liquor, and hard liquor, <br />apply to -wit: <br />(a) Alcoholic liquor An alcoholic beverage containing more than one - <br />half of one percent of alcohol by volume. <br />(b) Hard liquor An alcoholic beverage, including sweet wines and all <br />spirituous liquors, containing 14 percent or more of alcohol by volume. <br />(D) Malt beverage Beer, ale, porter, stout and similar beverages made of <br />barley malt, hops and water, containing more than one -half of one percent of alcohol <br />by volume and not more than 14 percent of alcohol by volume. <br />(2) Hard Liquor Consumption of hard liquor, or possession of any receptacle <br />containing any hard liquor is prohibited in all park and open space areas. <br />(3) Malt Beverages and Alcoholic Liquor Consumption ofmalt beverages and <br />alcoholic liquor, or possession of any receptacle containing alcoholic liquor or a malt beverage <br />which has been opened or had the seal broken or the contents of which have been partially removed, <br />is permitted in all park and open space areas except within: <br />(a) Children's playground areas; <br />(b) Athletic fields; <br />©) Wading pools; <br />(d) Tennis courts; <br />(e) Parking lots; <br />(f) Skateboard facilities; <br />Administrative Order - 12 <br />C AUser\ADM 1NORD\POS03.wpd <br />
