M <br />Administrative Order No. 58 -03 -24 <br />Public Works Department <br />City of Eugene, Oregon <br />PROPOSING THE AMENDMENT AND RENAMING OF <br />THE CITY'S PARK RULES; AND REPEAL OF <br />ADMINISTRATIVE ORDER NOS. 58- 98 -16-F AND 58- 03 -14. <br />The Executive Director of the Public Works Department of the City of Eugene finds <br />that: <br />A. Pursuant to the prior authority of Section 2.812 et seq. of the Eugene Code, 1971, <br />(subsequently repealed) which authorized the City Manager or designee to adopt Park Rules, and <br />Administrative Order No. 58 -92 -21 delegating authority for adoption of Park Rules to the Director <br />of the Public Works Department, on June 24, 1994, Administrative Order No. 58 -94 -12 was issued <br />adopting amended Park Rules. Those rules have subsequently been amended, most recently by <br />Administrative Order No. 58- 98 -16 -F, issued on October 20, 1998 and Administrative Order No. <br />58 -03 -14 issued on July 14, 2003. <br />B. City staff has recommended revisions to the rules, consisting of <br />(a) Renaming the rules "Park and Open Space Rules;" adding a definition of <br />"open space;" and inserting the phrase within applicable provisions of the rules; <br />(b) Amending Rule 1.003 for consistency with current code provisions and to <br />address applicability to open space; <br />(D) Adding Rule 1.04 regarding use permits; <br />(d) Amending Rule 1.007 to incorporate the amended regulations for possession <br />or consumption of alcoholic beverages adopted as an Emergency Rule by Administrative <br />Order No. 58 -03 -14 on July 14,2003; <br />(e) Adding to Rule 1.010 a prohibition regarding use of an area that is not open <br />for public use; <br />(f) Amending Rule 1.020 and Rule 1.025 to clarify their provisions; <br />(g) Amending Rule 1.050 to prohibit unattended and unsupervised pets, and to <br />amend the off -leash provisions; <br />Administrative Order - 1 <br />CAUserW DMINORD\POS03.wpd <br />
