ADIVILNISTRATIVE ORDER NO. 58 -95 -07 of the EXECUTIVE DIRECTOR OF THE PUBLIC WORKS DEPARTMENT EMERGENCY RULE AMENDING PARK RULE 1.003 CONCERNING PARK CLOSURES. The Executive Director of the Pubfic Works Department of the City of Eugene finds that: A. As the designee of the City Manager, I issued Administrative Order No. 58 -94 -12 adopting Amended Park Rules. B. Section 1.003 of those Rules sets forth the hours that City parks are closed. There have been occasions in the past when the illegal activities of persons using a park and /or the enforcement actions in curbing those activities have adversely impacted other parks and the residents of the areas in which the parks are located. It would therefore be in the public interest and promote the welfare and safety of those residents to amend Section 1.003 of the Park Rules to provide for the temporary closure of parks and /or facilities when the public need to preserve the welfare and safety of residents in the vicinity of the park(s) outweighs the public's right of access to parks and /or facilities. C. Because of anticipated enforcement activities, failure to act promptly in effecting this amendment will seriously prejudice the public interest, and this amendment should therefore be immediately effective. Therefore, based upon the above findings, and pursuant to the authority of Section 2.019(6) of the Eugene Code, 1971, Park Rule 1.003 is hereby amended to provide: PARK RULES 1.003 HOURS PARKS ARE CLOSED. Except for the Washington/Jefferson basketball facility, no person other than law enforcement officers, authorized personnel, or persons lawfully driving through the park may enter or remain in any park area between the daily closing time of 11:00 p.m. and the daily opening time of 6:00 a.m. In addition to any closures or reductions in services dictated by budgetary constraints, the Director may temporarily close all or any portion Emergency Rule - 1
