Intergovernmental Agreement. of January, 2002 Regarding Bus Rapid <br />Transit <br />Between the City of Eugene (City) <br />and'Lane Transit District (LTD) <br />This Intergovernmental Agreement (IGA) sets forth the general terms of an agreement <br />between the City and LTD. <br />WHEREAS, City and, LTD` haveagreed to work cooperatively to design, construct, and <br />maintain a' 'Pilot Project of the Bus Rapid Transit (BRT) system; and <br />WHEREAS, City and LTD have agreed to work cooperatively on the planning for future <br />improvements to the Pilot Project and on future BRT corridors within the City. <br />NOW, THEREFORE, the parties hereby agree as follows: <br />1. DEFINITION OF TERMS <br />The terms within this agreement have the following meanings: <br />1. "BRT Policy Team" means the policy team composed of high-level managers from the. <br />City and LTD as selected by each of them. <br />2. "BRT Steering Committee"-means the advisory committee composed of: three LTD Board <br />members; one policy level representative from each of the City, City of Springfield, and <br />Lane County; a management level representative from the Oregon Department of <br />Transportation (ODOT); and two citizen representatives. <br />3. "City" means the City of Eugene. <br />4. "Conceptual Design" means the Project design, as setforth as Attachment B, `existing as <br />of the date of this Agreement, to which all governmental" stakeholders have given <br />preliminary approval: <br />5. "Design Team means the team composed of architects, engineers, and other needed <br />disciplines to be engaged by LTD. <br />6. "PEPI Process" means the City's regulatory design review, compliance-and inspection <br />process for privately engineered` public improvements, including all permitting and fee <br />requirements generally applicable to construction in the public right-of-way,. and of public <br />improvements, generally: <br />7. "Project" means the Pilot Project, as defined in Section:ILA. <br />8. "Significant Changes" means those design decisions or changes to a.prior approved <br />design, which the Eugene members of the BRT'Policy Team. identify as requiring approval <br />by the Eugene Planning Commission. <br />9. "TAC" means the currently established Technical Advisory-Committee responsible for <br />design recommendations during construction of the Project. <br />10 "Within the City" means inside-the City's municipal boundary or otherwise under City+ <br />jursidiction. <br />Eugene-LTD IGA for Bus Rapid Transit Page 1 of 7 <br />
