ADMINISTRATIVE ORDER N0.58-04-12-F <br />of the <br />City Manager of the City of Eugene <br />AMENDMENT TO THE WASTEWATER USER FEE <br />SCHEDULE AND REPEAL OF ADMINISTRATIVE ORDER <br />N0.58-03-09-F. <br />The City Manager of the City of Eugene finds as follows: <br />A. Section 6.411 (formerly Section 7.020) of the Eugene, Code, 1971, <br />authorizes the City Manager to determine and set fees and charges to be imposed by the <br />City for wastewater service, regional wastewater service, and stormwater service. <br />B. In accordance with the procedures set forth therein, on May 24, 2004, I <br />issued Administrative Order No. 58-04-12, and notified the Mayor and City Councilors that I <br />intended to increase the Wastewater User Fee Schedule established by Administrative <br />Order No. 58-03-09-F on July 17, 2003, as set forth in the Notice attached thereto, <br />effective for all bills issued on or after July 1, 2004, except for all septage hauler fees which <br />will be effective for all septage hauler charges incurred on or after July 1, 2004. <br />C. Notice was also provided to the news media, any person who had requested <br />notice, and to interested governmental agencies (including the United States <br />Environmental Protection Agency, the Department of Environmental Quality, MWMC, and <br />the Eugene Water & Electric Board). In addition, the Notice was posted at two locations at <br />City Hall on May 28, 2004, and published on two separate occasions in the Register- <br />Guard, anewspaper of general circulation within the City, on May 28 and 29, 2004. The <br />Notice was made available for inspection by interested persons at the offices of the Public <br />Works Department, 858 Pearl Street, Eugene, Oregon, 97401, during normal business <br />hours (8:00 a.m. to 5:00 p.m., Monday through Friday, exclusive of holidays). <br />D. The Notice provided that written comments would be received for a period of <br />ten days from the first date of publication and posting, and that comments would also be <br />received at the public hearing to be held in the Public Works Department, 858 Pearl Street, <br />Eugene, Oregon, 97401, on June 10, 2004, between noon and 1:00 p.m:. No written <br />comments were received during the ten-day comment period. Five people testified at the <br />public hearing. One person supported the rate increase. Four people were opposed to the <br />rate increase, to which I make the following findings: <br />Comment 1: Dick Beers testified that he was opposed to the increase. He felt that <br />money was being spent inappropriately on land acquisition for the "storm <br />wastewater" fee.
