ADMINISTRATIVE ORDER N0.58-04-13-F <br />-__. of the <br />City Manager of the City of Eugene <br />INCREASE IN STORMWATER USER FEES <br />The City Manager of the City of Eugene finds as follows: <br />A. Section 2 of Ordinance No. 19984 adopted by the Council and approved by <br />the Mayor on September 28, 1994 established monthly stormwater customer charges <br />effective November 1, 1994. Section C of Ordinance 19984 provided that future <br />adjustments to the monthly stormwater customer charges be effected by the City Manager <br />pursuant to Section 6.411 of the Eugene Code, 1971 (EC), which authorizes the City <br />Manager to determine and set fees and charges to be imposed by the City for wastewater <br />service, regional wastewater service, and stormwater service. <br />B. In accordance with the procedures of EC Section 6.411, I issued <br />Administrative Order No. 58-04-13 on May 24, 2004, and notified the Mayor and City <br />Councilors, that I intended to increase the stormwater User Fee Schedule as set forth in <br />Exhibit A attached thereto. <br />C. Notice was also provided to the news media, any person who had requested <br />notice, and to interested governmental agencies (including the United States <br />Environmental Protection Agency, the Department of Environmental Quality, MWMC, and <br />the Eugene Water & Electric Board). In addition, the Notice was posted at two locations at <br />City Hall on May 28, 2004, and published on two separate occasions in the Register- <br />- Guard, a newspaper of general circulation within the City, on May 28 and 29, 2004. The <br />Notice was made available for inspection by interested persons at the offices of the Public <br />Works Department, 858 Pearl Street, Eugene, Oregon, 97401, during normal business <br />hours (8:00 a.m. to 5:00 p.m., Monday through Friday, exclusive of holidays). <br />D. The Notice provided that written comments would be received for a period of <br />ten days from the first date of publication and posting, and that comments would also be <br />received at the public hearing to beheld in the Public Works Department, 858 Pearl Street, <br />Eugene, Oregon, 97401, on June 11, 2004, between noon and 1:00 p.m.. One written <br />comment was received during the comment period, and three comments_were_made at the <br />public hearing. Of the four comments, three supported the rate increases. One comment <br />was made which expressed opposition to the rate increases, to which I make the following <br />findings: <br />Comment 1: Charles Biggs stated his opposition to the proposed increase. He <br />opined that funding for the programs restored by the increase should come from the <br />"City budget" (General Fund) and that the funding could be derived from the $9.2 <br />million QWEST judgment.
