ADMINISTRATIVE ORDER NO.58-99-28 <br />of the <br />Executive Director of the Public Works Department <br />ORDERING THE RESTRICTION OF MOTOR VEHICLE <br />ACCESS TO SKINNER BUTTE PARK BETWEEN 5:00 P.M. <br />ON DECEMBER 31, 1999 AND 8:00 A.M. OF JANUARY 1, <br />2000. <br />The Executive Director of the Public Works Department of the City of Eugene finds <br />that: <br />A. Section 1.003(2) of the Park Rules, as amended by Administrative Order No. 58-98- <br />16-F on October 20, 1998 authorizes the temporary restriction of vehicular access to City parks <br />during hours the parks are normally open upon finding that such restriction is necessary for the <br />preservation of the health, welfare and safety of residents of the City. <br />} ' B. At the present time, the gate to the upper portion of Skinner Butte Loop is required <br />TM ` to be closed at 11:00 p.m. and reopened at 6:00 a.m. On many occasions there have been large <br />congregations of persons in the upper parking lot and the City has been unable to effect their <br />removal and secure the gate by 11:00 p.m. <br />C. Every New Year's Eve creates added demands on Police Department services, and <br />it is anticipated that there will be a significant increase,this New Year's Eve. Closing the gate to <br />vehicular access at 5:00 p.m. on December 31, 1999 instead of 11:00 p.m. will avoid potential <br />exposure of the communications system to damage, enable the Police Department to maintain <br />flexibility in staffing, and eliminate the need to deploy Police personnel to close the gate at a time <br />when their services are likely to be needed in other areas of the City. <br />D. I find the early closure to be in the public interest, and necessary in order to preserve <br />the health, welfare and safety of the citizens of the City of Eugene. <br />Now, therefore, based on the above findings, which are hereby adopted, <br />I hereby Order that: <br />1. The gate on the upper Skinner Butte Loop Road (located near the intersection of <br />Skirmer Butte Loop and Third Avenue) be closed, restricting vehicular access, other than police <br />vehicles or authorized City employees, between the hours of 5:00 p.m. on December 31, 1999 and <br />8:00 a.m. on January 1, 2000. <br />2. Nothing contained in this Order shall limit the public's right ofnon-vehicular access <br />to the park between the hours of 6:00 a.m. and 11:00 p.m. <br />r <br />Administrative Order - 1 <br />r:\adminorder\99/3lgateord.wpd(12/ 17/99) <br />
