<br />ADMINISTRATIVE ORDER <br />of the <br />City Manager of the City of Eugene <br />Emergency Rule R-5.045 -Establishing Procedures <br />for Appealing Trat1"ic Control Administrative Actions <br />The City Manager of the City of Eugene finds that: <br />A. Under the provisions of Section 5.040 of the Eugene Code, 1971, the City <br />Manager has authority to administratively establish, maintain, remove or alter traffic control <br />areas and traffic control devices. Such action is subject to appeal in the manner set forth <br />in Section 5.045 of the Eugene Code, 1971. <br />B. Section 2.019 of the Eugene Code, 1971 authorizes the City Manager to <br />adopt rules necessary for the administration or enforcement of provisions of the Eugene <br />Code, 1971. <br />C. The City traffic engineer, as designee of the City Manager, is frequently <br />required to establish, maintain, remove or alter traffic areas and traffic control devices. <br />These actions cover a wide range of activity, and it would therefore be in the public <br />-- interest to promulgate rules establishing the procedures to be followed with respect to <br />appeals involving those traffic control administrative actions. <br />D. Because these types of administrative actions occur on a regular and routine <br />basis, failure to act promptly in adopting this Rule will seriously prejudice the public <br />interest in that no clear guidelines presently exist for processing appeals under Section <br />5.045 of the Eugene Code, 1971 of traffic control administrative actions of the City <br />Manager or the Manager's designee. <br />Now, therefore, based upon the above findings, <br />I hereby adopt the following Procedures for Appealing Traffic Control <br />Administrative Actions Administrative Rule R-5.045: <br />PROCEDURES FOR APPEALING TRAFFIC CONTROL <br />ADMINISTRATIVE ACTIONS EMERGENCY RULE R-5.045 <br />R-5.045-A AUTHORITY. <br />These regulations are authorized by Section 2.019 of the Eugene Code, 1971, and <br />,. _. <br />~ Administrative Order - 1 <br />
