ADMINISTRATIVE ORDER NO. 58-95-07-F <br />of the <br />City Manager of the City of Eugene <br />ESTABLISHING FEES FOR ENGINEERING SERVICES <br />FOR PRIVATELY CONSTRUCTED PUBLIC IMPROVEMENTS <br />AND REPEALING ADMINISTRATIVE ORDER NO. 58-94-13-F <br />The City Manager of the City of Eugene finds as follows: <br />A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager, to determine <br />and set fees and charges to be imposed by the City for services, goods, use of municipal property, <br />and licenses and permits. <br />B. In accordance with the procedures set forth therein, and the further authority of <br />Section 7.I30 of the Eugene Code, 1971, on June 8, 1995 I notified the Mayor and .City Cauncii <br />that I intended to repeal the currently effective fees for engineering services for privately <br />constructed public improvements as established by Administrative Order No. 58-94-13 on August <br />1, 1994. The Notice was also posted at two locations at City Hall. on June 8, 1995 and made <br />available for inspection by interested persons at the offices of the City Manager, 777 Pearl Street, <br />Eugene, Oregon 97401 during normal business hours (8:00 a.m. to 5:00 p.m., Monday through <br />Friday, exclusive of holidays). The Notice provided that written comments would be received <br />thereon for a period of 15 days from the date of posting. No comments were received within the <br />time or in the manner required by the Notice. <br />C. I find that the fees set forth in Exhibit A hereto are consistent with applicable <br />policies and directives of the City Council, comparable to the fees established in other <br />jurisdictions and private businesses for providing such services, are based on the hourly rates of <br />engineering employees, and are necessary in order to comply with the City Council's directive <br />and the requirements of Section 7.130 of the Eugene Code, 1971 that the fee charged for these <br />services recover the City's full costs, including plan review, .engineering, inspection and overhead <br />costs. <br />On the basis of these findings, I order that: <br />1. The fees set forth in Exhibit A hereto are hereby established as the fees to be <br />charged for the engineering services for privately constructed public improvements as set forth <br />therein, effective 12:01 a.m., July 1, 1995. <br />2.
