Pro 1i'm of the City of Eugene <br />ESTABLISHING A FEE FOR LONG-TERM' USE OF THE SURFACE OF <br />THE PUBLIC RIGHT OF WAY, ADOPTING A REVISED RIGHT OF WAY <br />USE PERMIT FEE SCHEDULE, AND REPEALING <br />ADMINISTRATIVE ORDER NO. 58-94-O1-F. <br />The City Manager Pro 1~m of the City of Eugene finds as follows: <br />A. Sections 2.020 and 7.290 to 7.340 of the Eugene Code, 1971 authorize the City <br />Manager to determine and set fees and charges to be imposed by the City for services, <br />goods, use of municipal property, :licenses and .permits, and specifically including, fees for <br />permits, activities, or uses affecting the public right-of--way. <br />B. Pursuant to those provisions, on June 14, 1996 I issued Administrative Order <br />No. 58-96-13 proposing an amendment to the schedule of fees attached as Exhibit A to <br />Administrative Order No. 58-9.4-01-F to add a fee for long-term use of the surface of the <br />public right of way, as set forth in Exhibit A thereto. <br />C. Copies of the Notice were provided to the Mayor and City Councilors, posted <br />at two locations at City Hall on June 19, -1996, and made available for inspection by <br />interested persons at the offices of the City Engineer, 858 Pearl Street, Eugene, Oregon <br />97401, during normal business hours (8:00 a.m. to 5:00 p.m., Monday through Friday, <br />exclusive of holidays). <br />D. -The Notice provided that written comments could be submitted thereon for <br />a period of 15 days from the date of .posting. No comments -were received within the time <br />or in the manner required by ;the Notice. <br />E. I find that =the proposed fee' for long-term use of the surface of the public <br />right-of--way is consistent with .applicable policies and directives of the City Council, including <br />policies. developed through the Eugene Decisions process, is based on the City's estimation <br />of the costs associated with processing and monitoring such requests, is necessary in order <br />to recover the cost from the beneficiaries thereof. Administrative Order No. 58-94-O1-F <br />should be repealed, and the Right-of--Way Use Permit Fee schedule attached as Exhibit A <br />hereto adopted as amended herein. <br />On the basis of these findings, I order that: <br />1. Administrative Order No. 58-94-O1-F is hereby repealed, as of the effective <br />Administrative Order = 1 <br />
