(f) OF STORMWATER <br />SYSTEM ADMINISTRATIVE RULE ADOPTED BY <br />ADMINISTRATIVE ORDER NO. 58-95-19-F <br />The: City Manager of the City of Eugene finds.. that: <br />A. Pursuant to the authority contained in Section 2.019 and. Chapter 6 of the Eugene <br />Code, 1971, on 7anuary 14, 1997, the City Manager Pro Tem issued Administrative Order No. <br />58-97-O1 proposing the amendment of Section D.3.(fJ of Stormwater System.Administrative Rule <br />adopted by Administrative Order No. 58-95-19-F on August 20, 1996; to correct an inconsistency <br />in the time within which a responsible person may appeal. a notice of violation or a notice of civil <br />penalty; as set forth in the Notice of Intended Rulemaking attached as Exhibit A thereto.. <br />B. The Notice was published in the Register Guard, ~a newspaper of general circulation <br />within the City for five consecutive days; to-wit; on January 21, 22; 23; 23, 25, .1997, and made <br />available for, inspection by interested persons at the office of the Public Works Department, : <br />Administration Division, 858 Pearl Street, Eugene, Oregon 97401 during normal business hours <br />(9:00 a.m: to 5:00 p.m., Monday through Friday; exclusive of holidays).. <br />C. The Notice provided that written comments would be received thereon for a period <br />of 15 days from the first date of publication. No comments were received within the time or in <br />the manner required by the Notice. <br />D. I find that the amendment to Section D:3. (f) of the Rule is necessary in order to <br />correct an inconsistency with the appealprovisions of Section 2.021 of the Eugene Code, -1971. <br />Based upon. the above findings, which are hereby adopted, and pursuant to the authority <br />of Section 2.019 and Chapter 6 of the Eugene Code.; 1971, <br />The City Manager of the City of Eugene hereby orders that: <br />1. Section D:3.(f) •of the Stormwater System- Administrative •Rule adopted by <br />Administrative Order No. 58-95-19-F on August 20, .1996, is hereby;amended to provide: <br />D.
