ADMINISTRATIVE ORDER NO. 58-04-01-F of the AIRPORT MANAGER REVISION TO THE CAPTION OF SECTION 12 OF THE AIItPORT FEE SCHEDULE, AND ADDITION OF GROUND LEASE RATES TO SECTION 15; AND REPEAL OF ADMINISTRATIVE ORDER NOS. 58-03-10-F AND 58- 03-22-F. The Airport Manager of the City of Eugene finds as follows: A. Authority is granted to the City Manager of the City of Eugene under Sections 2.440 to 2.442 of the Eugene Code, 1971 to set fees and charges for the use of the Eugene Airport. The City Manager has further delegated that authority to the Airport Manager under Airport Rule 8.4.2. B. Pursuant to that delegated authority, on. January 23, 2004, I issued Administrative Order No. 58-04-01, and notified the Mayor and City Council that I intended to amend the Airport Fee Schedule established by Administrative Order No. 58-03-10-F on July 15, 2003 (subsequently corrected by Administrative Order No. S 8-03-22-F on November i 2, 2003) as set forth in the Notice attached as Exhibit A thereto. C. Notice was also posted at two locations at the Airport and published in the Register Guard, a newspaper ofgeneral circulation within the City, on January 23, 2004, provided to persons who had requested notice, persons who are currently paying such charges, and was made available for inspection by interested persons at the offices of the Airport Manager, 28855 Lockheed Drive, Eugene, Oregon 97402 during normal business hours (8:00 a.m to 5:00 p.m., Monday through Friday, exclusive of holidays). D. Notice provided that written comments would be received for 1 S days from the date ofposting and publication. No comments were received within the time or in the manner described in the Notice. However, during the comment period, Administrative Order No. 21-04-02-F was issued establishing, in part, that the charge for major documents would be the actual cost of printing. A notation has been added to the Miscellaneous Fee section of the Airport Fee Schedule tt~ reflect that policy. E. Based upon the above findings and the findings inAdministrative Order No. 58-04-01, and after investigating the amount charged for such use in the past; comparable amounts or rates charged by other airports; the amounts or rates and other municipal benefits agreed to by comparable users of the airport in a contract, lease, or permit; and, the revenue needs of the airport, I have determined that the Airport Fee Schedule should be amended as proposed.
