As a City engineered and constructed project (eligible for aSSessrnent financingj. <br /> City agrees: <br /> a) to perform engineering design, cost estimate, award of oantrac~ cons#ruc~on inspection, and assessment <br /> tabulation for the improvements; <br /> b) to partiapate in the cost of necessary adc~ional capacity of improvements beyond the assessable amounts <br /> as stipulated in the Eugene Muniapal Code. <br /> Omer agrees: <br /> a) to pay all en~~neering and construeion costs whid~ are not dtgible for assessment financing. <br /> ` b) if the undersigned owner chooses to disconfinue the City engineering and construction process prior to <br /> execution of a construction contract, the owner further agrees to pay all engineering and otherproject-related <br /> costs incurred by the City to that point, and to comply with paragraph 2 blow, if applicable. <br /> 2. As a privately engineered and constructed project with private financing arranged by the or~mer. <br /> Owner agrees: <br /> a) to install all required pubic improvements at no cost to the Cify; <br /> b} to pay actual City costs incurred for plan review and processing, inspection, materials testing, and other <br /> engineerir~ services, all of which will be b+~led and payable monthly with final payment due prior to Cify's <br /> final aa~eptance of the corrq~eted improvements. <br /> c) to provide the City a band, which in~dudes a one-year warranty period, in an amount sufficient to cover all engineering and <br /> <br /> . oanstruction associated with completion of the required pudic improvements. <br /> d) tv pay other charges and levies•for public improvements, rf required. Other charges may include, but are not~limited to: <br /> 1 ~ penaty charges: in the event the property awner fail to make payment when due urger th~ agreementt, the property <br /> owner shag be charged a penalty in the amount of S25 or ten percent (10°/0~ of the past due amour, whichever is <br /> greater. Payment of the penalty shall not oonsitute a waiver by the City of i~ other remedies. <br /> 2j interest charges: property owner shall pay interest on all past due amotm#s at the rate of e~hteen percent (180) <br /> per annum #rom the due date unfit paid.
