ADMINISTRATIVE ORDER NO. 5~ - gy -a 7
of the
City Manager of the City of Eugene
EME ENCY RULE CLARIFYING REDUCTIONS AND EXEMPTIONS TO
MON Y STORMWATER CUSTOMER CHARGES.
The C Manager of the City of Eugene finds that:
A. On September 28, 1994, Ordinance No. 19984 was passed by the City Council
and approved by the Mayor adopting changes to the monthly stormwater customer charges,

~ separating out components related to roads.

d~

f .
B. As amended by Ordinance No. 19984, the monthly stormwater customer charge

s ~ is now comp sed of (1) a water quality and quantity component; (2) an administrative
j component; a d (3) a road component. It was intended that reductions and exemptions continue
to be availabl for water quality and quantity components for property, but not for the road

f

! component.

t
C. The rate methodology set forth in Exhibit A to Ordinance No. 19984, which
provides for c mplete reductions or exemptions, therefore should be amended to clarify that
exemption app ies to water quality and quantity components, but not to the road or administrative
component.
D. The new fees and revisions established by Ordinance No. 19984 go into effect
November 1, 994. That Ordinance, and Sections 6.411 and 6.451 of the Eugene Code, 1971
authorize the ity Manager to establish future adjustments to the stormwater customer charges
and adopt suc rules, regulations, and methodologies as deemed necessary by the City Manager,
' following the rocedures set forth in Section 2.019 of the Eugene Code, 1971..
E. Pursuant to section 2.019, the City Manager intends to follow formal rule making
procedures, i luding a notice and comment period with respect to longer term changes to the
~ stormwater ra a methodology that more accurately reflects the Council's action. In order to
ensure the Co ncil's November 1 imposition of the new fee structure is accurately carrted out,
it is necessar to change immediately the rate methodology to clarify that exemptions or
reductions do of apply to road or administrative components of the stormwater charges. The
City will imp se the new rates as of November 1, but may not send out the bills to heretofore
exempt prope ies until December, 1994 or January, 1995; in this event, the bills will reflect
amounts co encing November 1, 1994.
r
F. Failure to act promptly in effecting this clarification will prejudice the City's
implementatio of the proper stormwater customer charges.
Administrativ Order - 1
