I~, ADMINISTRATIVE ORDER NO. 5&95-10.F <br /> <br /> ~r ! of the <br /> City Manager of the City of Eugene <br /> ENDING PLAT CHECKING FEES FOR PARTITIONS; _ <br /> RA G OTHER PLAT CHECKING FEES; AND RESCINDING <br /> ADMINISTRATIVE ORDER NO. 53-91-15. <br /> The C ty Manager of the City of Eugene finds as follows: <br /> A. S tions 2.020 and 9.025 of the Eugene, Code, 1971 authorize the City <br /> Manager to et rmine and set fees and charges to be imposed by the City for services, <br /> goods, use of m nicipal property, and licenses and permits. <br /> B. In accordance with the procedures set forth herein, on September 19, 1995, <br /> I issued Adm ni trative Order 58-95-10, and notified the Mayor and City Councilors that I <br /> intended to a e~d the plat checking fees for partitions set forth in Administrative Order No. <br /> 53-91-15. A o~ice of Intended Increase in Partition Plat Checking Fees was attached as <br /> Exhibit A the et and incorporated therein by reference. The Notice was also posted at two <br /> locations at ity Hall on September 20, 1995, published in the Register Guard, a newspaper <br /> of general ci c lation within the City, on September 22, 1995, and made available for <br /> inspection by intjerested persons at the office of the City Surveyor, Public Works Engineering <br /> Division, 858 Purl Street, Eugene, Oregon 97401, during regular business hours (Monday <br /> ' through Frid y, exclusive of holidays). <br /> C. Tlhe Notice provided that written comments would be received thereon for a <br /> period of 15 days from the first date of posting and publication. No comments were <br /> received wit 'n ithe time or in the manner required by the notice. <br /> D. I and that the increase in partition plat checking fees set forth in Exhibit A <br /> hereto is co sis ent with applicable policies and directives of the City Council, including <br /> those develo a during the Eugene Decisions process, comparable to the fees established <br /> in other juri i ions for providing such services, in compliance with Section 9.025 of the <br /> Eugene Cod , 1971, and is necessary in order to comply with the Council's goal of <br /> recovering t e ost of providing the services from the beneficiaries of those services. <br /> E. I~ addition to partition plat checking fees, Administrative Order No. 53-91-15 <br /> also establis plat checking fees for subdivisions and partitions. I further find that it would <br /> be more effi ie t to rescind Administrative Order No. 53-91-15 and combine all the plat <br /> checking fee a reflected in Exhibit A attached hereto. <br /> On th asis of these findings, I order that: <br /> 1. Administrative Order No 53-91-15 and any other order in conflict with the <br /> fees establis ed and/or ratified herein are rescinded as of November 15, 1995. <br /> 2.
