S ction 2.019(5) of the Eugene Code, 1971 authorizes the City Manager to <br /> adopt temp ra rules deemed necessary for the administration and enforcement of <br /> provisions of th Eugene Code, 1971. <br /> B. In addition thereto, amendments to Sections 5.695, 5.697 and 5.698 of that <br /> Code specifi 11 authorize the City Manager to adopt rules that provide for the manner of <br /> providing not'ce of vehicle impoundment and establishing procedures for hearings related <br /> to such actin s. 'Those amendments become effective on October 12, 1995. <br /> C. V hides are subject to impoundment under provisions of the Eugene Code, <br /> 1971 and sta a w, and it is necessary that procedures be established to ensure that the <br /> notices and eaprings are in compliance with federal constitutional requirements of due <br /> process. <br /> Now, t e efore, based on the above findings, I hereby adopt the following Temporary <br /> Vehicle Imp u dment Notice and Hearing Procedures Administrative Rule R-5.698 to <br /> provide: <br /> Temporary Vehicle Impoundment Notice and Hearing <br /> Procedures Administrative Rule R-5.695 <br /> R-5.695-A A thori <br /> These re ulations are authorized by Section 2.019, 5.695, 5.697, and 5.698 of the <br /> Eugene Code 1 71, and are established to implement those provisions of Chapter 5 of the <br /> Eugene Code 1 71 that authorize or direct the impoundment of vehicles. Unless a different <br /> procedure is r 'ded in a provision of the Eugene Code, 1971, these procedures shall be <br /> followed whe a vehicle is impounded, or proposed to be impounded by the City. <br /> R-5.695-B tice Prior to Im oundment for Vehicles Stored on the Street. <br /> 1.
