<br /> f <br /> ~ ADMINISTRATIVE ORDER NO. 58-95 ~ 1"f <br /> of the <br /> EXE IVE DIRECTOR OF THE PUBLIC WORKS DEPARTMENT <br /> EMERGENCY RULE AMENDING PARK RULE 1.003 <br /> CONCERNING PARK CLOSURES. <br /> The Ex five Director of the Public Works Department of the City of Eugene finds <br /> that: <br /> A. s e designee of the City Manager, I issued Administrative Order No. 58-94-12 <br /> adopting Ame d Park Rules. <br /> B. ion 1.003 of those Rules sets forth the hours that City parks are closed. There <br /> have been occ si ns in the past when the illegal activities of persons using a park and/or the <br /> enforcement a tia~ns in curbing those activities have adversely impacted other parks and the <br /> residents of the ar in which the parks are located. It would therefore be in the public interest <br /> and promote th elfare and safety of those residents to amend Section .1.003 of the Park Rules <br /> to provide for a temporary closure of parks and/or facilities when the public need to preserve <br /> the welfare an s fety of residents in the vicinity of the park(s) outweighs the public's right of <br /> access to parks a /or facilities. <br /> C. use of anticipated enforcement activities, failure to act promptly in effecting <br /> this amendmen w 11 seriously prejudice the public interest, and this amendment should therefore <br /> be immediate) a ective. <br /> Theref re, based upon the above findings, and pursuant to the authority of Section <br /> 2.019(6) of the E gene Code, 1971, Park Rule 1.003 is hereby amended to provide: <br /> ~ _a PARK RULES <br /> 1.003 HOURS PARKS ARE CLOSED. <br /> x pt for the Washington/Jefferson basketball facility, no person other than law <br /> enforce e t officers, authorized personnel, or persons lawfully driving through the park <br /> may ent r r remain in any park area between the daily closing time of 11:00 p.m. and the <br /> daily o~en~ng time of 6:00 a.m. In addition to any closures or reductions in services <br /> dictated; by', budgetary constraints, the Director may temporarily close all or any portion <br /> Emergency Rine 1 <br /> i <br /> <br />
