(f) OF STORMWATER <br /> SYSTEM ADMINISTRATIVE RULE ADOPTED BY <br /> ADMINISTRATIVE ORDER NO. 58-95-19-F <br /> The ,City Manager of the City of Eugene finds that: ' <br /> A. Pursuant to the authority contained in Section 2.019 and Chapter 6 of the Eugene <br /> ode, 1971, on January 14, 1997, the City Manager Pro Tem issued Administrative Order No. <br /> 8-97-01 propo~ing the amendment of Section D.3.(fJ of Stormwater System Administrative Rule <br /> dopted by Adnnuvstrative Order No. 58-95-19-F on August 20, 1996, to correct an inconsistency <br /> t11e time wi ~ which a responsible person may appeal a notice of violation or a notice of civil <br /> e~alty, as set orth in the Notice of Intended Rulemaking attached as Exhibit A thereto. <br /> B. he Notice was published in the Register Guard, a newspaper of general circulation <br /> it~in the Ciry or five consecutive days, to-wit, on January 21, 22, 23, 23, 25, 1997, and made <br /> va~lable for ' pection by interested persons at the office of the Public Works Department, <br /> d~ninistration ivision, 858 Pearl Street, Eugene, Oregon 97401 during normal business hours <br /> 9:(~0 a.m. to 500 p.m., Monday through Friday; exclusive of holidays). <br /> C. he Notice provided that written comments would be received thereon for a period <br /> 'ved within the time or in <br /> is were recei <br /> ublication. No commen <br /> f ~5 days fro the first date of p <br /> e manner req fired by the Notice. <br /> ' D. find that the amendment to Section D.3.(f) of the Rule is necessary in order to <br /> orrect an inco istency with the appeal provisions of Section 2.021 of the Eugene Code, 1971. <br /> Based u on the above findings, which are hereby adopted, and pursuant to the authority <br /> f section 2.01 and Chapter 6 of the Eugene Code, 1971, <br /> The Ci Manager of the City of Eugene hereby orders that: <br /> 1. ection D.3.(f) of the Stormwater System Administrative Rule adopted by <br /> Administrative Order No. 58-95-19-F on August 20, 1996, is hereby amended to provide: <br /> Administrative Civil Penalty. <br /> The Notice of Civil Penalty shall: <br /> i <br /> Administrative !Order - 1 <br /> <br />
