ELECTRIC UNDERGROUND ELXTENSION AGRREEMENT C-~J~ 352 <br />Date of; Application: November 26, 2002 l• / <br />CITY' Ot= EUGENE, hereinafter called the customer, requests the Eugene Water & Electric Board, hereinafter called EWEB, to extend its electric system to serve: <br />'ect Name & Location: THE EUGENE DEPOT <br />~ 433 WILLAMETTE STREET <br />Customer agrees the electric distribution extension will be provided in accordance with the requirements and obligations of this Agreement and the <br />attached Exhibits. Utility service is also subject to EWEB's applicable policies, regulations and rates now in existence or hereafter adopted, and the attached <br />drawing #D-22409. Customer has received and read copies of EWEB's existing written policies and standards. <br />Customer will execute ail easements required by EW EB at no cost to EW EB. When practical, the customer will include such easements in the recorded <br />plat bf the above-mentioned development. Customer will further record deed restrictions requiring underground service to all properties to be served by the <br />und9rgrounCl distribution system being installed. Customer agrees that all easements shall provide that no buildings or structures may be constructed on such <br />eas~m~nts. <br />Customer is aware of the right, as provided in ORS 92.097, to employ a licensed engineer to design or supervise the installation of the improvements <br />provided for in this Agreement, but declines to do so. <br />Unless otherwise specified in this Agreement, the customer agrees to pay for the following extension charges prior to EW EB's commencement of work: <br />Contribution in aid of construction = $ 1,117 <br />Other = <br />Ap charges above are subject to change if this Agreement is not signed and returned within thirty (30) days of the application date above and if the <br />extehsion faccilites are not installed with permanent service connections within six (6) months of the date of application. <br />This Agreement authorizes EW EB to proceed with the necessary steps to provide electrical underground services as shown on the attached drawing; <br />howev8r, it is understood that until the conditions of this Agreement are complied with, EWEB will not install the extension facilities. <br />Customer agrees to inform all subsequent owners of the requirements and obligations of underground service in accordance with the Board's policies <br />and procedures. This Agreement shall bind and benefit the heirs, personal representatives, successors or assigns of the respective parties. <br />L~ EWEB-CONSTRUCTED SUBSTRUCTURES: ~` <br />', Customer will be responsible for providing, within six Inches (6") of final grade, compacted level ground of adequate width for EWEB <br />to install the utility systems. Customer will provide finished grade stakes and property corners so EWEB can install the utility system at <br />proper depth and location. Customer will monitor EWEB's Installation to assure the Installation is according to stakes that have been <br />provided. <br />CUSTOMER-INSTALLED SUBSTRUCTURES: <br />Customer will own and maintain all customer-installed ducts and vaults, Including service ducts in accordance with EWEB's service <br />', :policies. EWEB will own and maintain all other underground system facilities. It Is understood that the customer will construct and furnish <br />service lateral, Including duct, trench and backfill in accordance with EWER policy. <br />{~ Customer assumes all liability and agrees to Indemnify EWER for all damages to EWEB facilities caused by the customer or <br />~+" customer's agents. <br />After one year, EWEB shall assume ownership and responsibility for maintenance and repair of the service lateral conductors only. <br />(See Board Policy, Electric Service Section IID(5).) <br />DEVELOPER-INSTALLED SUBSTRUCTURES: <br />EWEB shall allow Developer to construct substructure facilities required to serve a development. <br />Electric substructure Installed in accord with Construction By Developer (CBD) policy must complywith the CBD Handbook, approved <br />drawings, standards and material specifications. All work-wUl-b~inspected, and installations that do not complywili not be energized. Once <br />accepted, electric substructure installed by the CBD policy becomes the properly of EWEB.
