Contracts & Agreements <br />No. 23,076 <br />City of Eugene Contract 2006-00222 <br />LOCAL AGENCY AGREEMENT <br />SURFACE TRANSPORTATION PROGRAM -URBAN <br />Chad Drive: Old Coburg Road -North Game Farm Road <br />Amendment No. 1 <br />The State of Oregon, acting by and .through its Department of Transportation, <br />hereinafter referred to as State, and the CITY OF EUGENE, acting by and through its <br />elected officials hereinafter referred to as "Agency," entered into an Agreement on <br />February 14, 2006. Said Agreement covers the extension of Chad Drive to connect with <br />North Game Farm Road. <br />It has now been determined by State and Agency that the Agreement referenced above, <br />although remaining. in full force and effect, shall be amended to .include right of way <br />services. <br />Paragraph 1 of Special Provisions, Page 5, which reads: <br />1. Agency, or its consultant shall, as a federal-aid participating preliminary <br />engineering function, conduct.the necessary field surveys, environmental studies, <br />traffic investigations, foundation explorations, and hydraulic studies, identify and <br />obtain all required permits, assist State with acquisition of necessary right of way <br />and/or easements, and perform all preliminary engineering and design work <br />required to produce final plans, preliminary/final specifications and cost <br />estimates. <br />Shall be deleted in its entirety and amended to read: <br />1. Agency,. or its consultant shall, as a federal-aid participating preliminary <br />engineering function, conduct the necessaryfield surveys, environmental studies, <br />traffic investigations, foundation explorations, and hydraulic studies,. identify and <br />.obtain all required permits, acquire the necessary right of way and/or easements <br />as shown in the attached Exhibit B, by reference .made. a part hereof, and <br />perform all preliminary engineering and design work required to produce final <br />plans, preliminary/final specifications and cost estimates. <br />This amendment may be executed in several .counterparts (facsimile or otherwise) all of <br />which when taken together shall constitute one agreement binding on all parties, <br />notwithstanding that all parties are not signatories to the same counterpart. Each copy <br />of-this amendment so executed shall constitute an original. <br />Except as expressly amended above, all other terms and conditions of the Agreement <br />are still in full force and effect. The Parties certify that the representations, warranties <br />and certifications contained in the original Agreement are true and correct as of the <br />
