things, cigarettes, water, and cookies. <br />(4) By lifting the fence to assist in sending food and water to the Traveler, Mr. Mooney aided <br />and abetted activity within a City park that is prohibited by Park Rules and a posted "No <br />Trespassing" sign. <br />(5) Aiding and abetting any activity or conduct within a park or park facility that is prohibited <br />by the Park Rules and a posted sign is a violation of Park Rules Section 1.010(m) and EC <br />4.010(2)(b)2. <br />(6) The City of Eugene properly issued Mr. Mooney the Notice of Restriction of Use for <br />violating Park Rule Section 1.010(m), "Aid and Abet Treesitter." <br />(7) Prevention of future violations similar to the one at issue in this appeal can be achieved by <br />restricting Mr. Mooney's entrance and/or use of the area commonly known as "the Park <br />Blocks," identified by a green outline on the map attached to this decision as Exhibit A. The <br />additional restrictions in Notice of Restriction ofUse No. 02 -19907 are not necessary for that <br />purpose and should be removed. <br />Appeal Process: The restriction of use as modified by this decision is effective immediately. Any <br />appeal of this decision must be filed, in writing, with the Executive Director within 15 days of the <br />date of the decision. Thus, an appeal must be filed by November 13, 2002. Pursuant to Section <br />2.021 of the Eugene Code, the appeal must state: (1) the name and address of the appellant; (2) the <br />nature of the determination being appealed; (3) the reason the determination was incorrect; and, (4) <br />what the correct determination of the appeal should be. An appeal will be heard by a hearings <br />official appointed by the City Manager within thirty days of the receipt of the notice of intent to <br />appeal. At the hearing the appellant may present testimony and oral argument personally or by <br />counsel. <br />ff-SISJUAII "WA <br />Kurt X.
