ADMINISTRATIVE ORDER NO. 58-12-10 <br />of the <br />Executive Director of the Public Works Department <br />TEMPORARY AMENDMENT OF PARKS AND OPEN SPACE RULES <br />ADOPTED BY ADMINISTRATIVE ORDER NO. 58-11-05-F REGARDING <br />POSSESSION AND CONSUMPTION OF ALCOHOLIC LIQUOR IN <br />MANGAN PARK. <br />The Executive Director of the Public Works Department finds that: <br />A. Section 2.019 of the Eugene Code, 1971 authorizes the City Manager to adopt <br />rules for administration of provisions of the Eugene Code. Pursuant to the authority of <br />Administrative Order No. 21-03-12 issued by the City Manager, the Executive Director of the <br />Public Works Department is authorized to regulate City parks, protect park visitors and the park <br />environment, and adopt rules regarding the use of parks. <br />B. On November 17, 2011, I issued Administrative Order No. 58-11-05-F adopting <br />the City's Parks and Open Space Rules. <br />C. In response to the increase in alcohol - related problems at Mangan Park and the <br />onset of warmer weather, on April 11, 2012, the Steering Committee for Active Bethel Citizens <br />unanimously supported a recommendation to request that the City of Eugene designate Mangan <br />Park as alcohol -free. <br />D. Over the past two years, Public Works and Police staff have documented a series <br />of illegal behaviors at Mangan Park associated with alcohol consumption; including, urination <br />and defecation on park grounds, littering (including the alcohol containers), verbal assault, and <br />vandalism. Use of Mangan Park by the public, especially children, increases dramatically during <br />the summer months. <br />E. Based on the alcohol - related illegal activity that is currently occurring at Mangan <br />Park and the onset of summer weather that will increase park use by children, failure to act <br />promptly to ban the possession and consumption of alcoholic liquor at Mangan Park will result <br />in serious prejudice to the public interest. <br />Now, therefore, based on the above findings, which are hereby adopted: <br />IT IS HEREBY ORDERED THAT: <br />1. The Parks and Open Space Rules are temporarily amended to add Mangan Park to <br />Section 1.007(2)(b). <br />Administrative Order - Page 1 of 3 <br />
