OSPD did <br />not issue a citation to the dog trainer at the site but stated that one could be issued. <br />Upon further discussion with local OSPD I was informed they, feel this law applies to all <br />lands within the state whether privately or publicly held. OSPD referred me to Oregon. <br />Department of Fish and Wildlife for further information. OF &W staff confirmed both the <br />existence and interpretation of the nesting law. However, it was also stated there has been <br />controversy about including training of dogs within this restriction and that the Oregon Fish <br />and Wildlife Commission may reconsider this issue later this summer. <br />Unfortunately, I cannot continue to permit dog training at Golden Gardens between April l S` <br />and July 31" with OSPD taking the position that Golden Gardens Park falls within the <br />nesting area definition.
