OSPD did
not issue a citation to the dog trainer at the site but stated that one could be issued.
Upon further discussion with local ORD I was informed they feel this law applies to all
lands within the state whether privately or publicly held. OSPD referred me to Oregon
Department of Fish and Wildlife for further information. OF &W staff confirmed both the
existence and interpretation of the nesting law. However, it was also stated there has been
controversy about including training of dogs within this restriction and that the Oregon Fish
and Wildlife Commission may reconsider this issue later this summer.
Unfortunately, I cannot continue to permit dog training at Golden Gardens between April 1 st
and July 31 with ORD taking the position that Golden Gardens Park falls within the
nesting area definition. Due to this, effective immediately all Dog Training Permits for
Golden Gardens are suspended until August 1, 2010.
If this changes we will let you know.
Thank you,
Johnny R Medlin, Director
Eugene Parks and Open Space Division
