May 18, 2010 <br />1620 ROOSEVEakoo <br />EUGENE, (191001! 47402 <br />(541) 682 4800 <br />FAX (541) �82•4882 <br />YdVd WIKENf- 4R.GOV/PARKS <br />PARNS 6919 PACE KAR ING. <br />PARK UPERAT€ONS, <br />URBAN FORESTRY <br />NATURAL RESOURCES <br />To all 2010 Golden Gardens Dog Training Permit holders, <br />On Monday May 17 a dog training permit holder for Golden Gardens Park was confronted <br />by two Oregon State Police Officers who required the dog trainer to cease training activities. <br />The OSPD officers cited Oregon Law which forbids allowing dogs at large or dog training <br />in areas of nesting game birds between April 1 and July 31 <br />Regarding the defiitioin Of a nesting area, I was tol Withe fact we do have both newborn <br />geese and ducks at Golden Gardens Parks would satisfactorily meet that criteria. OSPD did <br />not issue a citation to the dog trainer at the site but stated that one could be issued. <br />Upon further discussion with local OSPD I was informed they feel this law applies to all <br />lands within the state whether privately or publicly held. OSPD referred me to Oregon. <br />Department of Fish and Wildlife for further information. OF &W staff confirmed both the <br />existence and interpretation of the nesting law. However, it was also stated there has been <br />controversy about including training of dogs within this restriction and that the Oregon Fish <br />and Wildlife Commission may reconsider this issue later this summer. <br />Unfortunately, I cannot continue to permit dog training at Golden Gardens between April 1 <br />and July 31 with OSPD taking the position that Golden "Gardens Park falls within the <br />nesting area definition. Due to this, effective immediately all Dog Training Permits for <br />Golden Gardens are suspended until August 1, 2010. <br />If this -changes we will let you know. <br />Thank you, <br />J Director <br />Eugene Parks and Open Space Division <br />
