May 18, 2010
E U G E N F
( Pees' a0 f!
1E r1 To: all 2010 Golden Gardens Dog Training Permit holders,
On Monday May 17 a dog training permit holder for Golden Gardens Park was confronted
Keeplog E008 CPO40 by two Oregon State Police Officers who required the dog trainer to cease training activities.
The OSPD officers cited Oregon Law which forbids allowing dogs at large or dog training
ADfS'l 10NOM6E(eNMS in areas of nesting game birds between April 1" and July 31ST .
 °05tr °u
Regarding the definition of a nestin g area, I was told that the fact we do have both newborn
EdiE, uSEGUN 4SAEfY` g .
geese and ducks at Golden Gardens Parks would satisfactorily meet that criteria. OSPD did
j54l1 6s2a a 9a . g
Fr.l$all:6a2:seti not issue a citation to the do trainer at the site but stated that one could be issued,
Upon further discussion with local OSPD I was informed they feel this law applies to all
lands within the state whether privately or publicly held. OSPD referred me to Oregon
Department of Fish and Wildlife for further information. OF &W staff confirmed both the
existence and interpretation of the nesting law. However, it was also stated there has been
OM Pf4NiNfi controversy about including training of dogs within this restriction and that the Oregon Fish
and Wildlife Commission may reconsider this issue later this summer.
PdKMPEkAfl05 Unfortunately, I cannot continue to permit dog training at Golden Gardens between April 1'
and July 31' with OSPD taking the position that Golden Gardens Park falls within the
unn r uEStar nesting area definition. Due to this, effective immediately all Dog Training Permits for
Golden Gardens are suspended until August 1, 2010.
aso°ac
If this changes we will let you know.
Thank you,
Johnny R Medlin, Director
Eugene Parks and Open Space Division
