(MDA 11 -11) and (SDR 11 -3) <br />After recording, return to: <br />City of Eugene <br />City Recorder's Office <br />777 Pearl Street <br />Eugene, OR 97401 <br />MEMORANDUM OF PLANNED UNIT DEVELOPMENT MODIFICAnnON AND <br />STANDARDS REVIEW PERFORMANCE AGREEMENT <br />On December 8, 2011, the City of Eugene Planning Director approved a Modification (MDA 11 -11) <br />to a Planned Unit Development (PD 97 -8) and a Standards Review (SDR 11 -3), as requested by the <br />City of Eugene Public Works Department, hereinafter referred to as "Developer," for the <br />development of a neighborhood park, hereinafter referred to as "subject property.' The <br />Developer and the City of Eugene, a municipal corporation of the State of Oregon, hereinafter <br />referred to as "City," have entered into a Performance Agreement governing the Planned Unit <br />Development Modification a Standards Review approval granted by the Eugene Planning <br />Director. The subject property involves Tax Lot 4700 of Assessor's Map 17- 03- 08 -23. A legal <br />description of the subject property is attached as Exhibit "A ". <br />The use and development of the subject property is governed by the terms and conditions of that <br />Performance Agreement and the attached plans and specifications made by and between the <br />parties. All other provisions stated in the original performance agreement (PD 97 -8) and approved <br />site plans or portions of approved site plans not revised, remain applicable.
