<br />SAMPLE <br />CDBG FUNDED PUBLIC IMPROVEMENT CONTRACTFOR USE WITH <br /> <br />OREGON STANDARD SPECIFICATIONS FOR CONSTRUCTION <br /> <br /> <br /> <br />BETWEEN: <br /> The City of Eugene, an Oregon <br />Municipal Corporation (City) <br /> <br />AND: <br /> __________ (Contractor) <br /> <br />A __________ in the State of Oregon <br /> <br />CONTRACT NO.: <br /> __________ - __________ <br /> <br /> <br />PROJECT: <br /> <br /> <br />RECITALS <br /> <br /> <br />Contractor was the successful bidder for the contract for construction of the public improvement project <br />RFQ 2010200077 <br />described in the plans and specifications that were included in the bid documents () and <br />the Oregon Standard Specifications for Construction which form a part of this contract. <br /> <br />Funding for the Project is being provided in whole or in part from proceeds of a Community Development <br />Block Grant (“CDBG”) from the U.S. Department of Housing and Urban Development (“HUD”), and is <br />subject to HUD regulations. <br /> <br />AGREEMENT <br /> <br /> <br />The Contract. <br />1. The Contract between the City and Contractor (the Contract) includes this Document <br />and its exhibits, together with all of the documents and materials included in the definition of the <br />Contract under the 2002 Oregon Standard Specifications for Construction issued by the Oregon <br />Department of Transportation, as modified by the City’s Supplemental Standard Specifications, <br />Supplemental Specifications for the Project and any other Special Provisions included in the Bid <br />Documents (all specifications and Special Provisions included in the Contract are collectively referred <br />to herein as the Specifications). In addition, the Contract between the City and Contractor shall be <br />deemed to incorporate all reports, records, laws, rules and orders referenced in the Contract <br />documents. <br /> <br />This Document includes and incorporates the following Exhibits: <br /> <br />Exhibit A - City’s Standard Conditions for Public Works Contracts <br />Exhibit B- Contractor’s bid proposal for the Project, including but not limited to, all unit <br />costs and price schedules, Contractor’s certification of drug testing program <br />and disclosure of first-tier subcontractors, <br />Exhibit C - Contractor – Subcontractor Data Reporting Sheet <br />Exhibit D - Specifications <br />Exhibit E - Additional Federal Requirements, including, but not limited to: <br /> <br />E-1 Federal Labor Standards Provisions (HUD Form 4010) <br />E-2 Section 3 of HUD Act of 1968 <br />E-3 Executive Order 11246 (Non-Discrimination <br />E-4 Copeland Anti-kickback Act <br />E-5 Davis Bacon Wage Determinations, if applicable <br />E-6 City of Eugene Definition of Good Faith Effort <br /> Attachment A: Statement of Compliance – Women and MBE Utilization <br /> Attachment B: Women and Minority Businesses Enterprises to be Utilized <br /> Attachment C: DBE – Non-Participation Contact Form <br />Public Improvement Contract for Use with Oregon Standard Specifications – Page 1 <br />(Revised February 2004) <br /> <br />
