ADMINISTRATIVE ORDER NO. 58-11-09 <br />of the <br />City Manager of the City of Eugene <br />PROPOSED AMENDMENT OF STORMWATER SYSTEM <br />ADMINISTRATIVE RULE AND REPEAL OF <br />ADMINISTRATIVE ORDER NO. 58-02-01-F. <br />The City Manager of the City of Eugene finds that: <br />A. Section 2.019 and Chapter 6 of the Eugene Code, 1971, authorize the City <br />Manager to adopt rules deemed necessary for the administration and enforcement of the <br />provisions of the Eugene Code, 1971. <br />B. On February 28, 2002, Administrative Order No. 58- 02 -01 -F was issued <br />amending and adopting the Stormwater System Administrative Rule. I intend to amend that <br />Rule to apply provisions within the Rule to the operation and maintenance of private vegetated <br />and mechanical stormwater facilities. The proposed amendments revise Sections B (Purpose), C <br />(Applicability), and E (Determination of Amount of Civil Penalty), and add Section H (Reports <br />Required by EC 6.615(4)) to the Rule. <br />C. Pursuant to Section 2.019(3) of the Eugene Code 1971, the Stormwater <br />Management Manual prepared by the City was used in preparing this Rule amendment in that it <br />contains example inspection and maintenance logs, and language regarding stormwater facility <br />inspection and maintenance logs. The Stormwater Management Manual is available for <br />inspection at 1820 Roosevelt Blvd, Eugene, Oregon, 97402. <br />Based upon the above findings, and pursuant to the authority of Section 2.019 and <br />Chapter 6 of the Eugene Code, 1971, I propose to amend the Stormwater System Administrative <br />Rule as shown in legislative format as follows: <br />STORMWATER SYSTEM ADMINISTRATIVE RULE <br />A. Definitions <br />In addition to the definitions set forth in Sections, 6.340, 6.406, of the Eugene Code, <br />1971, as used herein, the following words and phrases mean: <br />City stormwater system Those stormwater facilities located on City -owned <br />property, City right -of -way, City easements and any stormwater facility the City is <br />contractually or legally obligated to operate and maintain, including but not limited to: <br />1. An open drainage way serving a drainage basin which has been <br />accepted by the City; <br />2. A pipe or sewer and its related appurtenances which carries <br />stormwater and have been designed and constructed expressly for use by the <br />general public and accepted by the City; <br />Administrative Order - Page 1 of 12 <br />
