3. The park encroachment intrudes on park property only to <br />the extent necessary to provide the pedestrian access. <br />(b) The City is authorized to issue a revocable permit for a vehicular <br />access encroachment if all of the following conditions are met: <br />1. The park encroachment provides sole vehicular access to <br />the residence; and <br />2. The park encroachment does not interfere with the public's <br />use and enjoyment of the park; and <br />3. The park encroachment intrudes on park property only to <br />the extent necessary to provide the vehicular access; and <br />4. The park encroachment existed prior to August 3, 2009. <br />(c) For any other type of encroachment, the City is authorized to <br />issue a limited - duration revocable permit if all of the following conditions are <br />met. <br />1. The park encroachment impacts an area of the park that <br />is not typically used by the general public; and <br />2. The park encroachment does not interfere with the <br />public's use and enjoyment of the park, and <br />3. The park encroachment does not impact the natural <br />resource value or function of the park, and <br />4. The park encroachment does not interfere with the City's <br />ability to efficiently maintain or operate the park; and <br />S. The park encroachment has an identifiable benefit to the <br />public, such as increasing park security, deterring criminal activity, <br />beautifying the park, and/or maintaining an unmaintained portion the <br />park. <br />(c) A request to encroach upon park property must be submitted to the <br />Public Works Department (1820 Roosevelt Blvd., Eugene, OR 97402) by <br />completing an application form provided by the City. The application must be <br />accompanied by an application fee as established by Administrative Order of the <br />City Manager pursuant to section 2.020 of the Eugene Code. <br />Administrative Order — Page 17 of 18 <br />
