contract time and reasonable compensation for all costs resulting from the suspension plus a <br />reasonable allowance for overhead with respect to such costs. <br />FPN-RC. <br />16.5 <br />When a contract is awarded <br />INAL AYMENT OF ONESIDENT ONTRACTORS <br />to a non-Resident contractor and the Contract Price exceeds $10,000, the contractor is <br />required to report to the Department of Revenue, on forms to be provided by the <br />department, the total Contract Price, terms of payment, length of contract and such other <br />information as the department may require before the contractor may receive final payment <br />on the Public Contract. The city shall satisfy itself that this requirement has been complied <br />with before the contracting agency issues a final payment on a Public Contract. <br />CT <br />16.6. <br />ONTRACT ERMINATION <br />16.6 .1 TBVL. <br /> A contract may be terminated <br />ERMINATION FOR REACH OR IOLATION OF AW <br />by the Purchasing Agent for breach or default by the contractor or if the contractor <br />violated applicable law. In the event of such termination, the contractor shall be <br />entitled to payment for the percentage of the contract completed, subject to <br />adjustment for damages and compensable losses suffered by the City as a result of the <br />breach or violation. <br />16.6 .2 CWCCTO <br />OMPENSATION HENONSTRUCTION ONTRACT ERMINATED FOR THER <br />BV. <br />Unless the contract expressly provides otherwise, <br />THANREACH OR IOLATION <br />when a Public Contract for construction Services is terminated for a reason other than <br />breach or default by the contractor, or as a result of the contractor’s failure to comply <br />with applicable laws, provision shall be made for the payment of compensation to the <br />contractor. In addition to a reasonable amount of compensation for preparatory work <br />and for all costs and expenses arising out of termination, the amount to be paid to the <br />contractor: <br />(a) Shall be determined on the basis of the Contract Price in the case of any fully <br />completed separate item or portion of the work for which there is a separate or <br />unit Contract Price; and <br />(b) May, with respect to any other work, be a percent of the Contract Price equal to <br />the percentage of the work completed. <br />16.6 .3RCWICT. <br />ESPONSIBILITY FOR OMPLETED ORKFONTRACT ERMINATED <br />Termination of the contract or a portion thereof shall not relieve the contractor of <br />responsibility for the work completed, nor shall it relieve the surety of its obligation <br />for any just claims arising from the work performed. <br />PAOPIC <br />16.7. <br />ROVISIONSPPLICABLENLY TO UBLIC MPROVEMENT ONTRACTS <br />16.7 .1 SF-TS. <br />UBSTITUTION OF IRSTIER UBCONTRACTORS <br />16.7 .1 .1 Applicable Law. <br /> A contractor may substitute a first-tier subcontractor that was <br />not disclosed with its Offer by submitting the name of the new subcontractor <br />Article 16 Contract Administration Page 82 <br />Exhibit A to Administrative Order No. 44-08-06-F <br /> <br />
