Agent’s estimate for the project or Procurement, the Solicitation Agent may negotiate the <br />Contract Price with the Responsible Offeror that has submitted the lowest Responsive Bid <br />or Quote. The Solicitation Agent may negotiate changes to particular items of the Goods, <br />supplies or materials that constitute value engineering or contractor performance terms that <br />reduce price but do not affect function.For purposes of this Section 6.11, value <br />engineering is a systematic and creative analysis of a contract item or task to ensure that <br />essential function of the item is provided at an overall lower cost. <br />ENI <br />6.12. <br /> In addition to notices of intent that are required to be <br />LECTIVE OTICE OF NTENT <br />issued under these regulations, the Solicitation Agent may issue a notice of intent to renew <br />or award any contract for the purpose of allowing affected Persons to file a protest of the <br />intended act. Publication may be made in a newspaper of general circulation in the <br />Eugene/Springfield metropolitan area, or by electronic publication on the website where an <br />advertisement for the contract would be posted. If given, a notice shall Offer persons who <br />would be aggrieved by the action described in the notice with an opportunity to protest the action <br />by submitting a written protest as described for protests of award under Article 13, which shall be <br />the sole method for a Person aggrieved by the award to make a protest. <br />DSP;R <br />6.13. <br /> (ORS <br />ISCRIMINATION IN UBCONTRACTING ROHIBITEDEMEDIES <br />279A.110). <br />6.13 .1 PD. <br /> An Offeror or contractor may not discriminate <br />ROHIBITION OF ISCRIMINATION <br />against a subcontractor in the awarding of a subcontract because the subcontractor is <br />a minority, a woman or an emerging small business enterprise certified under ORS <br />200.055. <br />6.13 .2BC. <br /> Discrimination against a minority, women or emerging <br />REACH OF ONTRACT <br />small business enterprise certified under ORS 200.055 under any city contract <br />constitutes a breach of contract that permits the city to: <br />(a) Terminate the contract; or <br />(b) Exercise any of the remedies for breach of contract that are reserved in the <br />contract. <br />6.13 .3 DA. <br /> In addition to city’s remedies for breach, violation of <br />EBARMENT UTHORIZED <br />these regulations concerning discrimination shall be grounds for Debarment. <br />6.13 .4LA. <br /> The city may not allege an occurrence of discrimination in <br />IMITATION ON CTION <br />subcontracting as a basis for Debarment more than three (3) years after the alleged <br />discriminatory conduct occurred or more than three (3) years after the city, in the <br />exercise of reasonable diligence, should have discovered the conduct, whichever is <br />later. <br />PWP. <br />6.14 <br />UBLIC ORKS ROJECTS <br />Article 6 General Rules for Solicitations Page 33 <br />Exhibit A to Administrative Order No. 44-08-06-F <br /> <br />
