are enforceable, however, to the maximum extent permitted by the law. Should <br /> any such obligation be legally unenforceable, the City recognizes the political <br /> and moral commitments made. <br /> D. Should annexation occur, it is the intention of the City, assuming <br /> maintenance of current and expected revenues to: <br /> (1) Maintain the District's level of recreational programming; <br /> (2) Absorb all District employees into the City's Parks, Recreation <br /> and Cultural Services Department with the same status as other i ty <br /> employees. District employees will retain their original/ date of <br /> employment with the District (seniority date) upon transferring to <br /> City employment; <br /> (3) Maintain existing equipment and facilities of the District and <br /> to give priority to preservation and upgrading of the aquatic center; <br /> (4) Continue to develop and expand park and recreation programs and <br /> facilities in the North Eugene area. <br /> AGREEMENTS: <br /> 1. City Obligations (Emerald Park Facilities). In light of the <br /> recitals noted above and overall general budgetary constraints, and if <br /> annexation of the entire District occurs before June 30, 1996, the City agrees <br /> to maintain the existing operational and maintenance budget amounts for the <br /> Emerald Park Facilities. In particular: <br /> 1.1 Fiscal year 1992 -1993. If annexation occurs at any time between <br /> July 1, 1992, to June 30, 1993, during that time the City shall allocate <br /> resources for operation and maintenance of the Emerald Park Facilities <br /> and programs in the same amount and manner as contained in the adopted <br /> 1992 -93 budget of the District that is prepared consistent with the <br /> obligations set forth in Paragraph 7. <br /> INTERGOVERNMENTAL AGREEMENT - -2 _ <br />
