CITY has a Memorandum of Agreement with the U.S. Army Corps of Engineers (Corps), U.S. Environmental Protection Agency (EPA), U.S. Bureau of Land Management (BLM), Oregon. Division of State Lands (ODSL), and Oregon Department of Environmental Quality (ODEQ), to establish a comprehensive mitigation banking program to implement the West Eugene Wetlands Plan. B. The CITY is currently charging $50,000 per mitigation credit to recover the CITY's cost of developing and maintaining mitigation wetlands. C. It has been mutually agreed between Corps, EPA, BLM, ODSL, ODEQ, and the CITY that mitigation requirements for development of property identified as Tax Map # xx-xx-xx and xx-xx-xx , Tax Lot # -xxxxx, -xxxxx, -xxxxx ("Subject Property") located within the City of Eugene can be satisfied through the purchase of mitigation credits from the West Eugene Wetlands Mitigation Bank. D. DEVELOPER desires to fill xx acres of wetland, and to purchase from CITY mitigation credits to satisfy DEVELOPER's mitigation obligations. E. Under the permit # 200x-xxxx to be issued by Corps and permit # xxxxx-FP to be issued by ODSL, DEVELOPER is responsible for securing xx mitigation credits. AGREEMENT 1.
