• • <br />AGREEMENT <br />City of Eugene Contract 2009-05406 <br />BETWEEN: The City of Eugene, an Oregon Municipal Corporation (CITY) <br />AND: Lane County School District 4-J (DEVELOPER) <br />c/o Ben Brantley <br />715 West 4 h Avenue, Eugene, OR 97402 <br />DATED: August 6, 2008 <br />RECITALS <br />A. CITY has a Memorandum of Agreement with the U.S. Army Corps of Engineers (Corps), U.S. <br />Environmental Protection Agency (EPA), U.S. Bureau of Land Management (BLM), Oregon <br />Department of State Lands (ODSL), and Oregon Department of Environmental Quality (ODEQ), to <br />establish a comprehensive mitigation banking program to implement the West Eugene Wetlands Plan. <br />B. The CITY is currently charging $50,000 per mitigation credit to recover the CITY's cost of <br />developing and maintaining mitigation wetlands. <br />C. It has been mutually agreed between Corps, EPA, BLM, ODSL, ODEQ, and the CITY that mitigation <br />requirements for development of property identified as Tax Map # 18-03-17-20, Tax Lot # -05500, <br />("Subject Property") located within the City of Eugene can be satisfied through the purchase of <br />mitigation credits from the West Eugene Wetlands Mitigation Bank. <br />D. DEVELOPER desires to fill 0.07 acres of wetland, and to purchase from CITY mitigation credits to <br />satisfy DEVELOPER's mitigation obligations. <br />E. Under the permit # NPW-2008-349 issued by Corps and file # 40755-NP to be reviewed by ODSL, <br />DEVELOPER is responsible for securing 0.07 mitigation credits. <br />AGREEMENT <br />1. DEVELOPER will pay CITY the amount of $3,500.00 for mitigation credits. <br />2. After receipt of payment, CITY will notify Corps and ODSL that DEVELOPER's obligation for <br />wetlands mitigation has been met, and the CITY will allocate 0.07 credits from completed or <br />approved wetlands mitigation projects to meet the mitigation obligation covered by this Agreement. <br />CITY OF EUGENE <br />By: <br />signature) <br />Johnny R.
