McDonald Theatre <br />Rental Contract <br />AGREEMENT <br />This agreement is entered into on: Friday, January 26, 2007 between the McDonald Theatre / Kesey Enterprises (hereinafter <br />referred to as 'lessor" and: City of Eugene Parks and Open Space Division, 1820 Roosevelt Blvd. Eugene OR 97402, (hereinafter <br />referred to as "lessee"). <br />WITNESS <br />EVENT / PREMISES: Per the attached worksheet the venue will be used on Sunday April 29, 2007 for a.projected fee of <br />$1305.25 (including rent, services and staffing). Actual charges (as determined by hourly rates, additional usage and extra <br />services provided) will be determined at the conclusion of the event and billed accordingly. <br />PAYMENT PROVISIONS: Final payment due upon conclusion of event <br />3. DEPOSITS: Lessee agrees to submit a deposit roughly equal to Yrprojected cost of the room. CANCELLATION: Lessee will forfeit a o ~r~' <br />percentage of the dep s~i it for canceWionacling Cancellation 0-14 days prior to event: 100% <br />Cancellation 15-30 days: 75% <br />Cancellation 31-60 days: 50% <br />Cancellation 61 days or more: 25% <br />5. PERSONNEL: Lessee shall provide all personnel (per worksheet specs.) to properly conduct the event: <br />6. SOUND and LIGHTING EQUIPMENT: Lessee shall be responsible for any repairs or replacement costs of sound and lighting <br />equipment if deemed that equipment was damaged due to misuse by artist or lessee production staff. Maximum sound <br />pressure at front of house mix position shall not exceed 103 db, House production manager has final authority on this issue. <br />PLEASE INITIAL <br />7. METHOD OF PAYMENT: All applicable payments are due upon conclusion of the event. <br />The McDonald Theatre will receive payment for all sales from box office and Fastixx outlet sales. The McDonald Theatre <br />will pay Lessee the balance of ticket sales less all applicable fees upon conclusion of the event. <br />In the event that fees are in excess of box office and outlet sales Lessee will pay the balance upon conclusion of the <br />event. Checks should be made payable to the McDonald Theatre. <br />8. EVENT COORDINATOR: Lessee agrees to designate a member of their business or organization to act as an event <br />coordinator and must be available for the duration of the rental period. <br />9. MERCHANDISING FEE: If lessee Intends to sell merchandise at the event, a fee equivalent to 20% of gross <br />merchandise revenue is due upon conclusion and reconciliation of the event. All recorded material generated on-site <br />(i.e.. CD / DVD) that are intended for sale In house (even if merch. is to be shipped at a later date) Is subject to the <br />merchandise rate and all inventory and/or manifests must be approved by house manager. <br />10. USE OF THE PREMISES: Lessee shall use the above described premises for the exclusive pre-determined purpose stated <br />herein: Film Festival. <br />11. SMOKING: There is absolutely no smoking in the McDonald theatre at any time. Failure to enforce this regulation may cause <br />termination of this agreement and the lessor may recover possession of the premises. <br />12. MAINTENANCE: Lessee shall take good care of the premises and maintain all of the equipment, furnishings and furniture in <br />good condition during the term of this agreement. Failure to do so will result in additional repair or replacement charges, <br />
