Lease - reply #2
Jackie,
Making the first requested change will not substantially alter the City's rights under section 12 in the instance of eF
requested assignment. Because of that, there are not any legal implications you need to consider in conjunction with
the requested change.
i
As for the change requested to section 17.1, the standard of "gross negligence" is of course different from sim
"negligence" with the use of the former standard being more advantageous to the City. The lesser standard is
some of the City's other. leases and, therefore, I don't believe there is an existing policy requiring use of the m(
stringent language. That said, you should check with Cathy Joseph for her thoughts, if you haven't already do
copy of this e-mail, I will ask her to weigh in).
Long way of saying that we don't object to either change. Up to all of you (obviously) as to whether you find
acceptable from a business standpoint. j
Jill
HALLETT Jackie C <Jackie.C.HALLETT@ci.eugene.or.us> 2/20/2009 12:59 PM
Hi Jill,
Last June you provided me with revised lease agreement for Specialty Panel Products at City owned property at
North Garfield. It has taken us this long to reach this point however, there existing lease will be expiring on 2/2
I've attached our most recent document that was provided to Kevin Burgess (Attorney) for his review. Two of h
modifications requested in the email below, we agree too however, he is suggesting two language modifications
feel need to be run by your office.
These modifications are:
2. At 12, first sentence, add at the end "which consent shall not be unreasonably withheld."
3. At 17.1, 2nd to last sentence, remove the word "gross".
We hope to sign the agreement on Wednesday, March 3rd when the owner is in town. Will you be able to
two language additions/deletion requests in this timeframe?
Thanks again,
Jackie Hallett
682-4844
-----Original Message-----
From: Kevin Burgess [mailto:kburgess@wlrlaw.com]
Sent: Thursday, February 19, 2009 12:15 PM
To: HALLETT Jackie C
in
so (by
we
i
G
s
these
