STORM DRAINAGE MAINTENANCE AGREEMENT <br />BETWEEN: The City of Eugene, an Oregon <br />Municipal Corporation (City) <br />AND: Robert A. Meltebeke <br />Sara E. Meltebeke (Developer) <br />CONTRACT NO: 2006-00427 <br />RECITALS <br />A. Developer owns certain property within the City of Eugene, Lane County, Oregon <br />described in Exhibit "A" ("Property") attached hereto. <br />B. Developer has requested final subdivision approval for the Property. Developer's <br />proposed development involves the creation of storm drainage facilities as shown <br />graphically in Exhibit "B". <br />C. Easements for the storm drainage facilities are created on the plat. The easements shown <br />on the plat include a drainage easement in those portions of the Oldham Slough located <br />on the plat, and two public utility easements adjacent to the slough - offfc°onne ga. <br />f,ea44-n-the-subdivision-4o-tote-slvugh-and.one connecting the slough to the Leo Harris <br />Parkway. The public drainage easement created on the plat includes the right of access <br />for inspection and public maintenance purposed, which shall be accorded all appropriate <br />government agencies. <br />D. The storm water drainage system designed to provide conveyance of storm water runoff <br />to the slough and conveyance of water in the slough through the balance of the public <br />storm water conveyance system. <br />E. City and Developer wish to enter into this agreement to establish the mutual obligations <br />relating to the maintenance of the storm drainage system components developed on the <br />Property. <br />F. This storm drainage maintenance agreement becomes valid and binding at the time of <br />dedication of the public storm drainage easements. <br />G.
