Hagen Fire Road - City agreemoht 2005-00422 <br />This letter is to give notice of the City's intent to release the eas ent agreement <br />between Giustina Land & Timber Co. and the City of Eugene As provided in the contract: <br />"Section 9. Termination <br />9.1 Although the term of this Agreement is for five year in the event it is not used by Eugene for <br />a period of two years, or if otherwise abandoned y Eugene, the Agreement shall <br />automatically expire and Eugene shall upon r uest execute a recordable document <br />evidencing such expiration. <br />9.2 Eugene may terminate this Agreement a ny time by delivering to Giustina a document in <br />recordable form stating that this Agree ent is terminated effective on a datelollowing <br />deliver." <br />In a search of Lane County Recorded cuments, the City finds no recordation of the <br />easement agreement between Gius ' a and the City. If an easement was recorded with <br />the City, please provide a referen number or copy of the recorded document. The City <br />will then prepare the required re ordable document in proper form. <br />The City hereby terminates J.NKe easement agreement effective June 30, 2009, as there is <br />no longer a need for the e of the Mt. Hagen facility, nor the fire access road. The City is <br />in possession of three (3ykeys as provided with the Key Permit issues by Giustina. These are <br />being returned for your further use.
