LIGHTING AGREEMENT <br />An agreement made between the City of Eugene, herein called <br />City, and the Lane Transit District , herein called the contractor. <br />RECITALS: <br />1. The Downtown Development Board of the City of Eugene has <br />determined that portions of the Downtown Development District <br />parking lots require additional lighting for the convenience <br />of the users of the downtown area. <br />2. The contractor owns or controls property that is adjacent <br />to the parking lots requiring additional lighting. <br />3. The City and the contractor wish to cooperate in the provision <br />of lighting of those lots with the understanding that the <br />improved illumination is in the mutual interest of both the <br />City and the contractor. <br />THEREFORE: <br />1. City agrees to: <br />(a) Purchase and install according to Code 1-400Whigh-pressure <br />sign post "D" at <br />sodium light fixtures on the property at 10th and Olive <br />(location) <br />to light the adjacent parking area(s), the light fixtures <br />to be connected to contractor's electrical system for <br />the premises. <br />(b) Remove the light fixtures upon 60 days' prior written <br />notice from contractor. <br />2. Contractor agrees to: <br />(a) Continuously operate, maintain and repair the installed <br />light fixtures at its own expense, including but not <br />limited to the replacing of lamps with lamps of similar <br />LIGHTING AGREEMENT - 1 <br />
