If there's a dollar amount that can't be exceeded <br />in a year, the City will have to be the one to monitor costs. Adding the price review each year is fine. Richard had the language <br />of not to exceed XXX amount of $ per year and Marlin was not comfortable committing to that for a 3 year <br />contract, and wanted a clause that gave him the option to look at his prices each year in case of increases etc. <br />I highlighted the section they both agreed on adding. Please add the <br />clause in the appropriate place in the contract. The language in quotation marks below sounds fine. Use that unless there <br />is some standard phraseology that is preferred. Per your conversation with Marlin Otto, he <br />was concerned at locking into that set price for the 3 year contract. He would like a clause added something <br />
