The District shall be required to make all repairs, <br />maintenance and improvements in or to any portion of the property the subject of this leas, all of <br />which property shall be kept in good order, repair and condition by the District while this lease <br />agreement is in effect, except that the City shall maintain and repair all landscaping and irrigation <br />systems on the Property. <br />15. Services. The District shall furnish and pay for all public utilities, including electric <br />power, lights, water, heat, sewer services and street implements: used in connection with the <br />demised premises, except for water and electric power related to the irrigation system. <br />16. Design. The District agrees that the City must approve plans for all structure designs, <br />including locations on the site, and changes that affect traffic circulation, storm and sanitary <br />sewers, and general landscape and irrigation systems, whenever such changes are proposed. The <br />City agrees to not initiate any changes in like improvement on the Property without obtaining <br />approval of the District. The District and the City shall not unreasonably withhold such <br />approvals. <br />17. Attorney's Fees. In the event of any action, suit or proceeding and any appeal therefrom <br />is instituted on this lease and intergovernmental agreement, the prevailing party shall be entitled <br />to, in addition to the costs of and disbursements provided by law, such sums as the court may <br />adjudge reasonable as an attorney's fee in said suit, action or proceeding. <br />18. Notices and Payments. Unless otherwise notified in writing, all notices to be given the <br />District may be given personally to the District's Purchasing Administrator, or by depositing the <br />same.in the United States Mail to <br />Jeannette Bailor, Purchasing Administrator <br />Lane Transit District <br />P.O.
