AMENDMENT NO. #1 TO City of Eugene Contract No. 1997 -00410 This Amendment is made to the Lease Agreement dated June 10, 1997, between the City of Eugene (City) and Lane Transit District (LTD). The City and LTD mutually agree to the following and amend the contract referenced above as follows: LTD was billed and paid for annual lease and landscape maintenance services for calendar years 1997, 1999, 2000, 2003, 2004, 2005, 2006 and 2007. In error, the City did not bill LTD for lease payments or landscape maintenance reimbursement fees for 1998, 2001, 2002, 2008, and 2009. In consideration for the length of time past, the City will forgive the payments due for 1998, an amount which totals $3,221.30. In an effort to resolve this issue, the City and LTD agree that LTD shall make the following payment: 2001 Annual Lease and Landscape Maintenance Fees $3,221.30 2002 Annual Lease and Landscape Maintenance Fees $3,221.30 2008 Annual Lease and Landscape Maintenance Fees $3,221.30 2009 Annual Lease and Landscape Maintenance Fees $3,221.30 Total past due payments: $12,885.20 Exhibit B of the original Lease Agreement is amended to reflect the following changes: a. Land rental as of January 1, 2010: Current value of large raw land parcels per acre: $150,000.00 Value of the site (.396 acre) $ 59,400.00 Annual rent at 8% per year $ 4,752.00 Land value increases and decreases for the yearly contract payment will be based on a current market assessment performed by the City's Senior Real Property Officer. b. All landscape and facility maintenance (including mowing, weeding, pruning, fertilization, replacement planting, trash control, etc.) for the 6950 square foot site will become the responsibility of LTD as of January 1, 2010.
